Understanding the Licensing of Digital Images

Types of Licenses

There are several types of digital image licenses, each with its own set of rules and restrictions:

  • Royalty-Free (RF): This is the most common type of license for stock images, and the one Imagella uses. Buyers pay a one-time fee to use the image multiple times for various purposes, without paying royalties. However, there are restrictions on resale and mass distribution.
  • Rights-Managed (RM): For exclusive usage rights, buyers opt for RM licenses. The fee is based on usage specifics, such as duration, geographic location, and exclusivity.
  • Extended or Enhanced Licenses: These licenses extend the rights granted by RF licenses, allowing for broader usage, such as in merchandise or high-volume print runs.
  • Creative Commons (CC): CC licenses allow free use of images under certain conditions, with various levels of freedom depending on the specific CC license applied.

What Buyers Need to Know

When purchasing stock images, buyers must be acutely aware of the license terms to avoid legal complications. Here are key points to consider:

License Restrictions

Even with licenses that allow broad usage, there are often restrictions to be mindful of. For instance, many licenses prohibit the use of images in a way that the subjects might find offensive or that suggests endorsement of a product by the people depicted. Imagella does not restrict the use.

Purpose of Use

Buyers should ensure their intended use of the image is covered by the license. For platforms that allow the use of images for any purpose except directly selling the image and mass distribution, this offers significant flexibility for creative and commercial projects. However, understanding the fine print is crucial to prevent misuse. Imagella has no fine print.

Modification Rights

Some licenses allow buyers to modify images to fit their needs, while others restrict alterations. Knowing whether you can crop, edit, or otherwise change an image is essential for creative projects. Imagella allows any modifications.

Attribution Requirements

Certain licenses, especially Creative Commons, may require users to credit the original creator of the image. Failing to provide appropriate attribution can result in legal issues. Imagella does not require attribution.

Resale and Redistribution

Most stock image licenses, including those that offer broad usage rights, strictly prohibit the resale of the image itself and mass distribution. Imagella falls within this category. Buyers can use the image in marketing materials, designs, or digital content, but they cannot sell the image as a standalone product or as part of an image collection.
